Transportation Agreement
1. Pickup and Delivery Provisions
Standard Procedure
- The Carrier will pick up and deliver the vehicle to the Customer’s specified location.
- The Customer must verify the Carrier credentials and release the vehicle only to the Carrier dispatched by 365 Car Transport.
Residential Constraints
- Door-to-door service may be restricted due to zoning laws, low-hanging obstacles, narrow streets, or safety concerns.
Alternate Locations
- When direct access is not possible, both parties will agree on a safe and convenient alternate location for loading or unloading.
2. Date Estimates & Delays
Estimated Dates
- Pickup and delivery dates are provided in good faith and are estimates only.
Unforeseen Delays
Delays may occur due to:
- Weather conditions
- Road conditions
- Scheduling conflicts
- Mechanical issues
Liability:
Neither 365 Car Transport nor the Carrier is responsible for expenses such as rental cars, lodging, or other delay-related costs.
3. Vehicle Specifications & Additional Charges
Modifications
- Vehicle modifications (e.g., lift kits, lowered suspension) may incur additional fees.
Inoperable Vehicles
- Vehicles that cannot run but can roll and steer may incur extra charges.
Customer Disclosure Requirement
- All vehicle conditions must be disclosed at booking.
- Undisclosed conditions will result in immediate additional charges, payable directly to the Carrier.
4. Luggage & Personal Items
Allowed Items
- Items must be placed in the trunk or backseat below the window line
- Maximum combined weight: 100 lbs
Responsibility
- The Carrier is not responsible for personal items or damage caused by improper storage.
Prohibited Items
The following are strictly prohibited:
- Explosives or weapons
- Illegal substances
- Prescription medications
- Precious or high-value items
- Animals or plants
Discovered prohibited items may be confiscated or discarded.
5. Vehicle Damage & Liability
Carrier Responsibility
- The Carrier assumes full responsibility for vehicle damage and maintains required cargo insurance.
Insurance Claims
- All claims must be filed directly with the Carrier.
- 365 Car Transport is not involved in claims processing and assumes no liability for transit damage.
Liability Disclaimer
- 365 Car Transport is expressly not liable for damages, negligence, accidents, theft, or actions of the Carrier after vehicle loading.
Hold Harmless Agreement
- The Client agrees to indemnify and hold harmless 365 Car Transport from all claims arising from the Carrier’s actions.
Damage Reporting
- Damage must be reported immediately upon delivery and noted on the bill of lading.
- Claims must be submitted directly to the Carrier.
6. Payment, Pricing & Delivery Terms
Payment
- Full payment is due upon delivery via cash, cashier’s check, or money order.
Delivery Notice
- Customers receive a 4-hour advance delivery notice.
Missed Delivery
- If unavailable, storage fees at a nearby terminal are the Customer’s responsibility.
Pricing
- Rates vary based on timing, location, and service needs.
- Once a Carrier is dispatched with accurate vehicle information, pricing is final.
7. Cancellation Policy
Before Dispatch
- Free cancellation before Carrier dispatch.
After Dispatch
- The booking fee is non-refundable.
Competitive Posting
- If a competitor posts the order within 14 business days after cancellation, the booking fee remains non-refundable.
Terms of Use
Payments & Cancellations
- Full payment due at delivery
- Rates fixed after dispatch (with accurate vehicle information)
- Free cancellation before dispatch
- The booking fee is non-refundable after dispatch
Legal & Governing Law
- Governed by the laws of the State of Florida
- Exclusive jurisdiction and venue: Palm Beach County, Florida
Agreement Acknowledgment
